According to the incident report, Daniel Montalvo was using a weed wacker on Beghe's Malibu property last week when the device malfunctioned. Cops tell us ... a frustrated Montalvo "mistreated the device." That pissed off Beghe, who then got into a loud confrontation with Montalvo which became physical. Montalvo went to the Malibu cop shop and filed a report. The Malibu/Lost Hills Sheriff's Station investigated the incident and sent the case to the D.A. for possible misdemeanor battery prosecution against Beghe. more on this story

Brooke's lawyer, Lori Howe, and Charlie's attorney, Mark Gross, went into the chambers of Judge Hank Goldberg this afternoon and presented hizzoner with the agreement. We're told Howe and Gross told Judge Goldberg the only thing left to be done is getting Brooke and Charlie's John Hancock. Sources tell us ... the agreement calls for joint legal and physical custody of twins Bob and Max. We're told Brooke will get substantially more face time with the kids than Charlie. Multiple sources with direct knowledge of the baby saga tell TMZ ... Arnold never demanded a DNA test. We've also learned Baena never took steps to establish paternity through DNA. As for why Arnold was so sure he was the father ... our sources say Baena's husband was not even in the United States when the baby was conceived. He returned to the U.S. just days before the boy was born. By the time the boy was a toddler, it became "physically obvious" that Arnold was the dad, one source says. In fact, we're told several members of the Maria Shriver/Arnold Schwarzenegger staff sometimes confused Arnold's youngest son, Christopher, with Baena's child. more on this story

They had this to say about the song and video concept behind "Everybody": "This song was inspired by the people who really have changed and affected our lives. Before writing the song I sent out a tweet asking kids to tell me what their favorite qualities and memories are of their best friends. We got almost 100 tweets sent to us and then wrote the song using what they sent us to inspire us. All throughout this video I would love to use randomly flash as many of these tweets as we can whether it be on poster board that we have written on or using motion graphics to put the tweets on the road in front of where we are walking, cars driving by, windows of houses etc etc. The whole video would be shot as one continuous shot. TMZ has learned ... L.A. County Fire trucks and paramedics raced to the scene Thursday afternoon and several responders had to hike down the steep slope to retrieve the 23-year-old actor. We're told Finley was trying to make a turn on Mulholland Drive when he lost control of the bike and went crashing down the side of the cliff. Finley was transported to UCLA Medical Center ... where he was treated for multiple compound fractures as well as injuries to his face and head. We're told Finley has already undergone several surgeries to repair damage to his leg ... and will require more surgery in the near future. more on this story
