Wayne is suing Quincy Jones III over a documentary QIII did on him, claiming it's a "scandalous portrayal." Wayne also alleges producers didn't have the right to use his music in the flick. (You'll recall the hilarious deposition tapes we posted.) Our sources say they've been told it is "unlikely" Wanye will be able to testify on Monday and there is a "real chance" Wayne will not be witness ready for a significant period of time. Here's the problem. The case is being heard by a jury, so it's unlikely the judge will grant a continuance because it would unduly disrupt the jurors' lives. There are 2 other options ... declare a mistrial, or force Wayne's side to present its case without him. We're told lawyers for Wayne will inform the judge Monday morning on Wayne's status. TMZ broke the story ... Wayne suffered what we're told were 2 seizures on a private plane Thursday and was hospitalized until Friday afternoon. Although a woman claiming to be Wayne's rep says it was just a combo of dehydration and a migraine, people repping Wayne in an official capacity tell us they were told he suffered 2 seizures, which is consistent with what the pilot radioed to ground control. more on this story
TMZ was shooting footage when Mark Foster -- the guy who sings the annoyingly overplayed "Pumped Up Kicks" song -- was escorted out of The Sayers Club when someone saw him tooling around on his iPhone. Foster begged and pleaded with security to let him back inside -- using every tactic in the book: -- I have a tab at the bar I didn't close! ... and of course, "I'm Mark Foster ... from Foster the People." After a couple of minutes in limbo, security gave Mark a break and let him back inside ... but only after they MADE HIM check his phone. On his way out of the show, Mark told us it was a big misunderstanding ... he was simply checking a text message from a friend when he was tossed. He also said he understood why security did what they did ... telling us, "It's cool ... Prince doesn't play in front of 100 people every night." more on this story
40 -- real name Lawrence White -- just filed a lawsuit against Game over the July 7 incident that took place in front of a mansion in the Hollywood Hills. You probably saw the video. According to the docs, filed in L.A. County Superior Court, 40 says he was leaving a party, when he was jumped by Game and Game's 15-man entourage for no reason. Game recorded the fight on his iPhone and published the footage to YouTube -- under the title, "The Game Beats Up 40 Glocc Whilst Recording on iPhone Full Video." In his suit, 40 says the video does NOT show the full story ... claiming Game had chased after him with a gun ... and shouted, "Freeze or I'ma shoot, n*gga." 40 claims he tried to escape ... but Game caught up, pointed the gun at his chest and told him not to fight back or he would "end it right now." In the docs, 40 says he obliged ... and Game and Game's crew proceeded to beat him mercilessly ... causing major injuries to his right eye, ribs, kidneys, right shoulder and back. 40 also says he suffered wounds to his face, head, legs, arms and hands. 40 is suing for unspecified damages -- but we're guessing he wants MILLIONS ... not only for assault and battery ... but he also feels Game tarnished his thug reputation by portraying him as a coward on the YouTube video. At the time of the altercation, sources close to The Game told TMZ ... Game did NOT pull a gun during the incident and insisted "it was a one-on-one fight." Watch video here.
Sources connected to the show tell TMZ the producers are getting rid of Gloria, Laura Govan, Malaysia Pargo and Brooke Bailey because the wives, especially Gloria, weren't allowing "all of their reality to be filmed." We're told the breaking point came when Gloria (who is known for her feisty ways) jetted off to Vegas to marry Barnes -- and didn't even let the show know about it. Our sources say the producers felt extremely disrespected by her actions and made the decision to clean house. Our sources tell us the producers haven't told the wives they're getting fired yet, but are already looking for new women to fill their spots. Draya Michele and Jackie Christie will be the only returning members. more on this story

As TMZ first reported, the "Dallas" star was busted Thursday after TSA agents found an unloaded 9mm Glock and a novelty police badge in his carry-on bag. Scalia's rep, Steve Jaffe, tells TMZ the gun was a gift from a friend and the badge was a courtesy shield that was presented to him by former NYC mayor Rudy Giuliani. He doesn't know how either ended up in the bag. Scalia was released after posting a $10,000 bond. So far, no charges have been filed. more on this story
As we reported, Diddy was involved in a serious car accident in Beverly Hills -- and according to his rep, the rap mogul sustained injuries to his neck, ribs, and collarbone. Diddy was riding passenger when his SUV collided with another car. After the accident, Diddy was so in shock he had to lie down on the grass. Antelope Valley Plaza filed the eviction case against Tameka -- claiming she signed a two-year lease agreement back in 2010 for three retail spaces in a Georgia complex ... where she runs Kangazoom -- an indoor play center for kids. AVP claims in the docs Tameka was supposed to pony up $9,966.67 / month ... but she hasn't anted up for months -- and now owes $36,943.42 in back rent. But wait ... there's more. AVP claims she owes more than $4k in late charges, $2k in unpaid taxes all tolled, AVP is gunning for $49,816.18. Tameka says AVP is the one that breached the contract, and she wants the case dismissed. more on this story
The buyer is Steven Mayer, a investment banker. Our sources say the purchase price was somewhere between $17 and $20 mil -- it was listed for nearly $24 mil. And this is interesting ... for some reason the seller is letting Mayer move in before escrow closes -- something real estate honchos think is high risk. more on this story
Brown was supposed to appear in court earlier this month to prove he had completed the court-mandated alcohol education program -- per a plea deal he struck back in 2011 over his DUI charge from that same year. But Brown never showed -- and on October 23, the judge issued a bench warrant against him for $26,000. This is the third time Brown has missed a court date. As TMZ previously reported ... Brown has had TWO other bench warrants issued against him (one in May and one in July), all stemming from the same DUI charge and all for failing to show up in court and failing to prove he'd met his alcohol education requirements. more on this story

Cissy and Pat Houston (co-executors of Whitney's estate) ... had filed legal papers hoping to drastically change the way Whitney's fortune would be paid out to 18-year-old Bobbi .. because they felt it was "too much, too soon." As it stood, BK was to receive her money -- an estimated $20 million -- in 3 separate chunks ... 10% when she turns 21 ($2 mil), just under 20% at age 25 ($4 mil) and the remainder when she turns 30 ($16 mil). Now, we've learned ... the case has been dismissed after Bobbi and Cissy reached an agreement ... and sources tell us Whitney's originally plan for the payout was virtually unchanged. Still, we're told both Bobbi and Cissy are satisfied with the plan ... and are happy to put the case behind them. more on this story
Strahan JUST sold his swanky 2,560-square-foot Hermosa Beach condo for somewhere in the neighborhood of $1.85 mil. He originally paid $2,050,000 for the place. BUUUUUT ... Strahan bought the condo in 2005 ... at the height of the ridiculously over-inflated real estate market ... so to only take a $150k hit is pretty good. As for the property ... it's awesome -- 3 bedrooms, 3.5 baths, a rooftop deck, an elevator and it's less than one block from the Pacific Ocean -- which is by far one of the top 5 oceans. more on this story
Sources close to the ex-couple tell TMZ, Chad's on track to finish his batterer's intervention program in the next couple months -- at which point Chad will ask the judge to terminate his probation and lift the no-contact order. If that happens, Evelyn would have to get a civil restraining order to keep Chad away -- but we're told she has decided NOT to do that ... because she just wants to "move on." Chad was sentenced to one year probation and the batterer's class after pleading "no contest" to domestic battery following the August 11 fight with Evelyn -- but since he's completing the class early ... the judge can also lift the probation early. Despite Evelyn's decision ... we're told she does NOT want a reunion with Chad. more on this story
Sam is telling friends, there's no way Brit's ex-nanny Leah Frand could have known that the singer had crystal meth in the house ... because she was fired after only one week. Sam's claims contradict what Leah told us yesterday ... that she worked for Britney for 6 months back in 2007 -- during the crazy meltdown period -- and never once saw any trace of drugs. But Sam's saying that's not true -- telling friends Leah was quickly canned for stealing one of Britney's dresses (which she later returned) ... so her opinion counts for exactly zero. According to sources, Sam also wants to clarify one thing -- he never said Britney did crystal meth, only that he found a stash of crystal meth in her house. As for the Adderall accusations, Sam's saying Britney fueled herself -- taking WAY more than the recommended dosage of her (legal) Adderall prescription. more on this story
Emblem3 -- who made their name on "X" singing original songs -- is made up of three guys, ages 15 to 19. We're told the boys threw a massive party in their hotel room this week partying, which included other "X" finalists. According to our sources, it got so loud that hotel guests complained and called security ... who then shut down the party, and threatened to kick the boys out. We're told "X" producers -- who are footing the bill for all the contestants -- had to swoop in and save the day, by begging the hotel to let them stay. A source close to the show tells us, "All the partying Emblem3 is doing is distracting the other contestants and they've been warned to behave." more on this story
