Metallica Sellout 
Billboard reports: Making a case for hard music, stadium tours in general and Metallica's own status as a headliner, Summer Sanitarium 2003 goes down as a winner, taking in $46.4 million and drawing 683,472 headbangers to 19 dates. 

The tour reaffirms the box-office clout of Metallica, which is currently in the planning stages of an extensive headlining tour next year, tentatively set to begin in March. 

Metallica last toured in 2000, taking in $40.5 million from only 20 shows. About a dozen of those concerts were Summer Sanitarium dates, featuring Kid Rock, Korn and others. 

This year's Summer Sanitarium lineup featured Limp Bizkit, Linkin Park, Mudvayne and the Deftones, in addition to Metallica, and was one of only two stadium tours for 2003. (The other was Bruce Springsteen (news) & the E Street Band on a limited run.) 

While the Sanitarium lineup was powerful, Metallica was clearly the linchpin act in a summer crowded with multi-act hard-music tours. Whether the competition was Ozzfest ($23 million) or Lollapalooza ($14 million), Sanitarium easily came out on top, according to Billboard Boxscore.

Metallica is popular and all but Billboard should give a little credit to the other bands on the bill, most of whom are headliners in their own right, or have been in the recent past.  Then again it would interesting to find out how many people went solely to boo Limp Bizkit off the stage. 

Jacko Dismissed
AP reports: A judge dismissed two parts of pop star Michael Jackson's lawsuit against Universal Music Group that claims the world's largest record company owes him royalties for the rerelease of songs he made in the 1970s. 

The lawsuit, filed in May, accuses Universal of violating a 1980 agreement to pay Jackson royalties from recordings he made with the Jackson 5 and as a solo artist from 1969 to 1976 for Motown Records, which was acquired by the company. 

On Friday, Judge Emilie Elias tossed out Jackson's claim that Universal had a fiduciary duty to make sure he received the best financial deal possible. She also dismissed his conversion claim, which argued that Universal had improperly used the music in licensing. 

Eight of Jackson's claims remain in the lawsuit, including breach of contract.

McCartney Vs. Photographer
AP reports: Paul McCartney was involved in a scuffle Friday when a photographer tried to take his picture near the site of illusionist David Blaine's latest stunt. 

McCartney spokesman Geoff Baker said the former Beatle fired him when he learned that Baker had informed the photographer that McCartney would be visiting the site on the River Thames. Blaine is trying to live there without food for 44 days while suspended from a crane in a plastic box. 

Baker later said he'd been reinstated, and described reports of a "fracas" as exaggerated. 

London's Metropolitan Police, however, said they were investigating two counter-allegations of common assault following a dispute near Blaine's stunt between a photographer and a group of friends early Friday morning. The police didn't name anyone involved in the incident. 

Baker issued a statement:� "One of the lads tipped off the press, who were watching a man in a sleeping bag in a box, that Paul was passing," the statement said. "Paul then continued to joke by telling his mate, who is his publicist, that he was fired. 

"Paul then got into a car and went home. Reports that this was a fracas or anything other than a group of friends on a night out are heavily exaggerated." 

The Evening Standard newspaper said its photographer, Kevin Wheal, claimed he was hit after trying to take McCartney's picture. The paper said the star's friends told police they were assaulted during the incident- Click Here for the Full Story

Quiet Riot Silenced 
Roadrun.com reports: QUIET RIOT have officially split up, drummer Frankie Banali has confirmed.

In an e-mail to Metal Sludge, Banali wrote, "To be honest with you, I am [singer] Kevin [DuBrow]'s friend and will always be his friend. I don't want to get on the 'he said, you said" roller coaster that is always generated in these types of situations which are all so common with bands. It's pointless, it serves no one. The fact remains that the QUIET RIOT which included all original 'Metal Health'-era members Kevin DuBrow, Rudy Sarzo, Carlos Cavazo and myself has ceased to exist. This lineup was the most successful one during the early 80's and during the latter part of the 90's to date and we had a great and lengthy run."

QUIET RIOT's long-delayed DVD, titled "Quiet Riot Live In The 21st Century - 20 Years of Metal Health", is still believed to be on schedule for release on October 7. .- Click Here for the Full Story

Interesting but it would be even more interesting to see if an official announcement comes out of this, not just an email to Metal Sludge. The way that this is worded the group could still be together but just not with the original lineup. That is until they want to come on and feel the noise again. 

Slipknot Gets Neighborly. 
Roadrun.com reports: SLIPKNOT's "Welcome To Our Neighborhood" home video will receive a DVD release on November 18 through Roadrunner. The disc will contain all the original content plus about seven minutes of special additional concert footage of the track "Scissors", filmed during the band's appearance at Ozzfest 1999. Additional behind-the-scenes material will be included as well.

SLIPKNOT are currently working on the follow-up to 2001's "Iowa", tentatively due in early 2004 through Roadrunner. In the meantime, SLIPKNOT percussionist Shawn Crahan (a.k.a. The Clown) will release the debut self-titled effort from his new project, TO MY SURPRISE, on October 7.. - Click Here for the Full Story

Sharon Made Ozzy Do It
Roadrun.com reports: Sharon Osbourne defended husband Ozzy for mangling "Take Me Out to the Ball Game" Aug. 17 at Wrigley Field, telling Barbara Walters on ABC's "20/20" last week that the former BLACK SABBATH singer simply didn't know the words. "First of all, Ozzy has never watched a sports game in his life. He didn't know the song, and I just said, 'Come in and help me out. Don't let me go and do it by myself,' So he came in, and he's going, 'Game, peanuts, uh.' And then he's like going, 'Can we go home now?' "Click Here Full Story

Pop-Punk Xmas
Launch reports: Blink 182, the Mighty, Mighty Bosstones, and New Found Glory are among 20 artists set to appear on the Santa Clause '03, a Christmas-themed benefit album scheduled for release on November 11, according to Billboard.com. Blink 182 will perform "I Won't Be Home For Christmas," while New Found Glory's contribution will be called "Ex-Miss." The Bosstones' track, "This Time Of Year," was previously available only as a giveaway to people who attended the band's hometown Christmas shows in Boston. 

Other acts slated to appear on the record include Something Corporate, MxPx, and a collaboration between Deftones singer Chino Moreno and the now-defunct band Far. 

All proceeds from sales of the album will go to the Pediatric AIDS (news - web sites) Foundation.
