Your analogy places you at punishing the kids for drinking the soda... but if the soda was offered to them, isn't that kind of hypocritical? I think that Napster, very much deservedly, is taking the heat for being the middleman in this whole fiasco.

Your right messiah, people are the badguys in this situation, and other people who use napster to preview music and find rare song shouldnt lose napster, we can just take comfort that the people who get songs and make there own cds will all burn in hell =P

Dr. Fever, you and I both know each other. Yes it is me. We discussed this issue on my porch for over 2 hours. I see what you are saying, and I agree to some point. Understand this, as I stated on my porch, Napster is yet the playing field(if you will). A program that makes it possible to trade music between users. Now,...Napster is not responsible for the "fans" stealing the music or receiving it and placing it on the program for other users to share. It is kind of like a can of soda. I can place it between two kids and leave the room. Then eventually, one of the kids will decide to take a drink. The other kid sees this and decides he or she can also take a drink. I return to the room and catch them drinking it and decide they must be punished. I didn't mean for those children to take a drink, but it did happen. Same goes for Napster. You said it yourself, you use it to find rare songs. I use napster to decide wheither or not to buy a cd. If I don't like certain songs, it seems to me it would be a waste of money. I mean even CD Now provides a 30-40 second demo of certain tracks of a cd. As far as Metallica is concerned, I don't hold anything against them. I just think that if they are going to sue anyone, find and sue the people who are distributing songs like," I disappear" before the MI-2 soundtrack was available. I think it is presumptuous, for Metallica to sue a program like Napster. That would be like taking Netscape for providing a service to download porn to minors when Netscape only provides a navagator to other web masters web sites. Oh yeah and Limp Bizkit sucks! ps. I agree with your rant to a point, but beyond that point, I am afraid you are wrong. You are a huge fan of Metallica, I know this, but their are those who are bigger(not that I claim to be as big as you)fans and are discouraged by this, but please understand DJF...fans have a right to speak their mind wheither or not they truly are fans or not. Freedom of Speech is something you and I know alot about due to our major. Lets face it, you shouldn't tell anyone to shut the f*ck up. They do have the right to speak their mind!

I read your rant and you certainly have a point but to put so much blind faith in a BAND, for crying out loud. If Metallic tells you poop tastes like chicken are you going to eat it? This is all over money, if Metallica didn't care about getting paid and really cared about loyal fans like your self they would trust you to not rip them off. For Lars to go on TV and say that this is about anything other than money is very insulting. The Grateful Dead never cared about whether their fans were taping their shows and bands that are still active (Phish) follow this trend. This is not to say all bands should do this but goes show that Metallica has an issue with money, and nothing else.

Anyway, this isn't about Metallica, to begin with... it's about the (supposedly) illegal swapping of music, the blood, sweat and tears of these artists. Obviously I'm on the side of Metallica and Dr. Dre, but I try to be objective. It's alright if artists want to allow bootlegs and CD burnings, but ravenous record companies will never let this happen, at least not in the forseeable future.

Well, dude, Napster handled the banning of users, not Metallica. Metallica only wanted the mp3s from their cds banned. Of course, the morons at Napster don't know sh!t about Metallica and just banned anything that said Metallica in it, so basically you could have had some indie band with a song called "F@ck Metallica" and you would have been banned. Don't blame Metallica for Napster's stupidity.

hey guy who got banned from Napster for having that Metallica mp3: there's a loophole to get back on Napster, you dummy. All you have to do is lie and claim to Napster you didn't have any Metallica, and then Metallica has ten days in which to file a lawsuit against you (which they won't do, because they're not like that, and they haven't done that yet) and you're reinstated. All Metallica wanted was their files removed, but it's not possible.

I liked your article. I don't agree with every action Metallica took against Napster, but you made the point that I've been saying all along--a real fan of Metallica would buy the cds. People who claim Metallica were railing against their fans are idiots. I wouldn't consider a freckled 14 year old geek with no knowledge of music who has a "Hero of the Day" mp3 to be a Metallica fan, now would you? No. the only Metallica mp3s I have are concert ones, nothing else, and I'm not talking Live Shit either, I own that Boxed Set, yes, I paid for it. In fact, I've paid for every bootleg, everythign I own by Metallica. This Napster thing has been blown out. Nobody even talks about the fact that the biggest suit against Napster was placed by the RIAA--and they won! Metallica and Dre were threatening action, but their claims weren't even near as damaging. The new thing for me that annoys the hell out of me is this staged Offspring-Napster thing. Offspring have always loved Napster and tried to prove a point to people by selling Napster t-shirts and hats. Feeling Napster wouldn't retaliate, they figured this would show Napster to be a cool bunch of guys, to say "hey they aren't rushing to sue." Wrong. Napster filed a cease and desist and warned them not to do it anymore. Ironically, a few days later, this little cease and desist was lifted, said to be a "mistake", and the two of them teamed up and are now selling the t-shirts and donating the money to charity. CAN ANYBODY SAY "STAGED"? Basically, Napster was going to sue as well until they found out what Offspring were trying to do, so they basically retraced their footsteps and tried to cover up what they had done to save their image. Pathetic. Napster sucks. End of story. Connection rates suck there, you can find most of the files in any cd store, and as far as mp3 trading goes, it's inferior to many other services I've used to do this. Other places have much better selections, much easier usability, and much better connection speeds. People that think mp3 trading started with Napster are the same morons that think Windows is the only computer software out there.

Dear me. It sure is difficult to have an opinion these days isn't it? Can't we all just get along. Anyway, in regards to Napster and Metallica, what Napster is doing is wrong. I think that should be apparent to everyone. When you write something you own it. Lets compare a song to an invention. If someone invents something, not just anyone can go sell it. They have to get permission. Napster never got permission. Now I know this is obvious and has probably been said a million times but I felt I just had to say it again. Now all you scary people can go ahead and tear my opinion apart and threaten me personnaly :)

i agree with Dr. Fever's comments about religion.. but the only difference between he and I is that I AM an atheist... personally, I don't care what happens to Metallica or Napster.. I only own a couple Metallica albums.. and I don't even have Napster (mostly cuz my damn comp's too small to hold mp3s) although.. I dunno why people shouldn't feel betrayed.. I mean, seriously... if my name was on a list of 300,000 or so people that was turned in to the authorities... I'd be scared and pissed too... and I've said it numerous times... if it was all about Lars being online and finding an mp3 file of "I Disappear" online 3 months before the MI2 album was supposed to be released.. that maybe they should've concentrated on how it got posted in the first place... because if it was on a computer somewhere in storage (that had a connection to the net) and got hacked by someone... they should've known better.. or if it got out in disk form and ripped to mp3 later somewhere.. don't you think they should be looking for the leak?.. it just doesn't make sense to me... i dunno... anyway.. that's enough of me.. ok, a couple points. It's been brought to my attention that if you are a fan of a particular band and you bye a lot of there shyt then you are a sheep. Hmmm...now, that would make you a fan. BUT, if you belive that line of thinking then they're are a lot of ways you're a sheep. To me, the most obvious one is religon. Think about it...if you belive the line of thinking then all these people who go to church every sunday and wednesday, and go for every revival are all just sheep. the same people who line the churches pockets with money and bye bibles..they're just sheep. Now, let me clarify, i'm not some kind of atheist or some shyt...i belive in god, and heaven, and hell. But, unlike 95% of the people in my hometown, I don't turn my entire life over too it. So, think about it a second, IF you belive that being a diehard fan of a band, or singer or rapper or whatever makes you a sheep (you're only a sheep if you are a diehard fan of someone as long as they're popular or on mtv or both..then you are no longer a fan when they've been replaced by the next big thing and you become a 'diehard' fan of that artist..and so forth and so on) then my comments make sense. Otherwise, wake the hell up and realize that being an actually fan of a band and buying they're posters,t-shirts and shyt..this don't make you a sheep. Yes, this even applies to boy bands. Like I said, the sheep factor comes in when you change you're opinion when they're no longer on TRL. Think about it. Of course, like I always say, this is just my opinion, i could be wrong.

I love all these brainwashed fools commenting on metallica with all of this "real fan crap." the only one that you're fooling is yourself. Some JackA$$ was dumb enough to say "if you really like the band you will support them in whatever they do." Uh, does this include being sued for being a fan? when metallica was still good i would say yeah, ok metallica has the right to do this but come on... they've blown their wad. they screwed up in 1996 and as far as i go, they have paid for it ever since, I don't pay attention to anything they do unless someone else brings it to my attention. Unfortunately someone happened to waste my time telling me about this napster crap so therefore i know about it. But although metallica stinks nowadays so does every other rock band except for limp bizkit. I love the limp song on the MI2 soundtrack but i still refrained from buying it cause metallica is on the same CD. Damn Metallica is like the plague huh?

The issue here isn't really the fact that Napster was making the song available. It's the fact that they made the song available THREE MONTHS before the song was even finished and put on the M:I-2 Soundtrack. Metallica is one of the greatest and most successful bands in music history. They are OUR version of Zepplin, the Beatles, and Elvis. And each genre has evolved from the other. At least Metallica had the balls to do it first. I see all these people coming out with suits against Napster. I think the point is moot about eliminating MP3 trading. Its not like we stop CD burning, graphic/lyrical stuff on websites, and numerous other ways of copyright infringement. People will find new ways to get what they want. No use arguing about how lame or cool Metallica is or whether they sold out or are still the best metal band of all time. Metallica just seems to be a pawn in the (useless) fight against illegal markets. (LoKi Omega the Self-Proclaimed Genius)

I absolutely love that article. I'm not an old, back-in-the-day fan of Metallica but even I know that they've always done whatever they wanted, whether it pleases people or not. When I heard that they were sueing Napster I hardly that anything of it. When even my friend got kicked of Napster for downloading some Garage Days songs, I just told him to download it again. Of course he was kind of angry about it but it's just not a big deal to us. Like most of Durst's fans just act like they don't like Metallica just because Durst is acting like he's all pro-Napster. But we all now Durst is getting paid a bundle for his "free" tour hosted by Napster. I just can't believe how ignorant some of his fans are.

it's true..it's true, metallica may be acting anal about their music..but, the only thing is (i've been saying this pretty much all along), they were the FIRST to come out against napster, i will guarantee you that if metallica hadn't done it then someone else would have and all of us would be choosing sides on that one...so, keep in mind that it could have been anyone, but metallica just got there first. now, NO ONE else is gonna go as ballz to wall about it as metallica because they KNOW they'll get crucified....but, like i always say, this is just my opinion, i could be wrong.

Everyone likes to kinda shove the fact that Metallica built their fanbase off demo tapes in everyone's faces as some sort of agrument in their favor. Yet the problem with that argument is: Demo tapes are recorded with the INTENTION that they will be traded freely. They are made for that purpose and the band realizes this when they make a demo tape. No one gave Metallica a choice as to wether or not they wanted to have thier music on napster. And stormrider...you may be right..illegal is illegal, and there shouldn't be any different levels of it, but that's a whole other debate. The fact of the matter is if everyone went after EVERY little thing, it would be one big pain in the ass. If metallica sued someone for useing the metalistar image on their sight, then you @ssholes would be calling them sellouts even more. Yet you are complaining because they let that stuff slide but get made at their music being traded freely...damned if they do, damned if they don't. Make up your mind.

Metallica has left behind a lot of original fans. At one point, they were my absolute favorite band. You have to admit, they did change pretty drastically. They first became popular in the bootleg tape trade which, admit it or not, is the same thing as napster (you just have access to a lot more material.) I'm busting my @$$ in school to make money; if they think they're getting any sympathy about losing money, they got another thing coming. They nedd to concentrate on making an actual complete, original album, with no gimmicks like a symphony or a bunch of covers. MP3s aren't going anywhere. They need to get on with making music instead of persecuting people that are trying to listen to their music.

Hey... thanks for the intelligent reply. Now, the way I see it, if reproducing copywrited material is illegal, then it should be illegal. Not just when they feel like it. Just today, I was reading through a usenet newsgroup and someone had posted the lyrics to quite a few of Metallica's songs (the first 4 and reload for some strange reason). This is also reproducing their material. In the same newsgroup, someone else requested an image for the Metallica star... another person said it was on his website... now, I'm pretty sure those two didn't get permission from Metallica to reproduce that star, or for that one guy to upload that star onto his website. Would Metallica be after Napster if they advertized trading of any type of file? It just seems like Metallica are being anal about their music, and their rights. Just like I have a right to sit here and say "F*ck you!" to every person that talks to me, or saying "You suck! I'm right, you're wrong!!!" It doesn't really accomplish much, and I would probably be forced to live like a hermit. That's my gripe about this whole situation. If they want to be so anti-social, and act like they don't need anyone, they should just move to some remote island in the middle of the Pacific and stay there.

Stormrider...i hope you see this. Now, it would be easy to just sit here and flame you all night till the sun comes up, but that would accomplish nothing. I will admit, you make some vaild points..honestly. BUT, i'd like to clarify something for you so maybe you'll have a better understanding of the good doc. First, all those years ago when i first go into Metallica it wasn't as some sort of 'crutch' to get through youth..hell no! it was because they rocked (and I feel they still do). As far as you comments about metal fans...hey, i like metal as much as the next guy. Give me Slayers' "angel or death" or "war ensemble" and i'm happy. But, i'm MORE into the (for lack of a better term) modern metal...and i DO NOT mean shYt like korn and limp and all that shyt. i mean bands like snapcase, hatebreed, zao, messhugah, indescision, brothers keeper, coalesce, etc...basically hardcore/metalcore music. So, am I a card carrying headbanger..no..do i like/appreciate metal? hell yeah. To close, i'd like to add that,yeah, I do have a bias in this column and i will TRY to avoid such things in the future...well, except next month, that's gonna be another bias column. BUT, the way i look at it is the whole damn thing boils down to copyrights. and, the way i see it, napster is a music provider JUST as much as radio. So, i think they should have to pay their BMI/ASCAP fees just the same as my college radio station and the 'real' radio station i work for. if this were the case, then everything with napster would just be ducky and no one could bytch 'cause they'd be gettin a few extra bucks on the royalty check at the end of the month. But, then again, this is just my opinion i'm sure a lot of you will disagree..and that's fine. That's the basis (in my mind) of this column..essentially a free exchange of ideas and thoughts on topics...

you know... i'd never call myself a "die hard" fan of any band, genre, or artist (with the exception of maybe Soundgarden)... and i wouldn't say i'm a "big fan" of Metallica... the three albums i like best are ...And Justice For All, Load, and Reload... in that order... i havn't heard all of their stuff... don't really care to... but what i have heard (well most of it..) i liked... but the one thing i don't understand is... how could this be stealing?... what are they taking?... a crappy sounding, condensed copy of a song... that ANYONE can get on CD ANYWHERE... (well.. after it's released)... i could see how it could be considered stolen if some guy copied something like... say, a SONG.. and then replayed all the instruments himself... and rerecorded the whole thing and then put his name on it... and then tried to market it as his own... THAT would be stealing.... now, as far as the copyright thing... there are two ways to copyright music... 1) copyright performances of music... and 2) copyright recordings of music so technically... if a band has a song copyrighted for performance.. it would technically be illegal for someone like a small, unsigned band to cover it... and it would be just as illegal for them to record it for something like a demo... (since that IS a recording.. and ALL bands/artists have their recordings copyrighted...)... so how is Napster any different than some small, unsigned band... playing say Enter Sandman at a public performance without Metallica's consent?... just a little question... (this one's sure to get some flames calling me stupid.. but hey, i never said i was a copyright attorney... ) -0

I agree with some of this. Although I like neither Metallica or Fred Durst, I do agree that suing Napster will not eliminate MP3 pirating. I mean, god, why not use it to your advantage? release singles or something on Napster to promote CD's. In fact, CD sales have been increasing since Napster use. I think you have a bit of bias here but that is to be expected from a "Metallica fan".

metallica doesnt realize that they will stay in business as long as there is a demand for their music, no matter what. do they really think that some computer nerd is going to say 'oh, metallica are playing in town tonight, but I'd rather just sit here and listen to their music on my pc rather than see a live show' I mean get real here

Also... I'd like to comment that not all musicians agree with Metallica's (Ca$htallica) actions. I'd love to have my stuff up on Napster... any exposure is good exposure, no matter what. The difference between the Metallica of old and this new... 'band' is that back in the 80s, if a fan came up to James and said 'hey, your new song Fight Fire With Fire ass!! I got it from a friend of mine!' James would have been like 'f*ckin' cool, man!'. These days, it's 'Hey, I heard your new song 'I Disappear' and I think it kicks ass! I got it from Napster!' the response would be 'Well, you're a f*cking theif, you shouldn't be listening to my music for free'. But hey, that's what money does to ya... basically, artists make whatever they create to 1) get satisfaction that they created it and nothing else or 2) Get enjoyment out of sharing it with others so they can appretiate it. Art has nothing to do with business. Metallica aren't artists, they're businessmen, trying to secure their profits. From my standpoint as an artist, the only reason I wouldnt want someone to copy my art was because they could SELL IT IN THEIR OWN NAME. And obviously, everyone knows who Metallica are, and knows their songs... so I don't think they have to worry about that.

Hahaha... 'True Metallica Fan' huh? I stopped reading when I got to this line. That simply spells out sheep in any metal head's book. You see, there's a difference between an angry teenager who just listens to metal because he's mad at the world, and a person who loves metal because it's in his blood... a True metal fan. None of these 'True Metallica Fans' were metal fans to begin with. They just needed something to get them through adolecence. You may be proud to be a 'true fan' of one single BAND, but you were/are a completely false fan of the ENTIRE genre of metal. Whimps and posers, LEAVE THE HALL

He he, I think dimmaen just proved your point, Dr Fever. Eagles is right, people have been saying Metallica sold out since ride the lightening. And every album since then. With every album they have changed their style a little. Yeah, there was a big change between the black album and load...but there was also a 5 year period between them where the band members did their own thing and grew as people...and since Metallica makes music they feel like, that's why there was such a change.

Thank you Dr. Fever for another great enlightening column. Now some comments for dimmaen, it doesn't make sense to say how Napster is bringing up business for musicians(if you can call N sync that) and then say Metallica is doing it for the money. Because if its bringing up business they would obviously have the information on that (and yes Napster cd sales are definitely on a rise whether because of or in spite of Napster) and they wouldn't be attacking Napster for the money. They would be doing it for the obvious reason that its common thievery. As Lars has said its penny change what they are losing (if they are losing anything from it). The band just disagrees with it in principle and the fact that people can go and get anyone of their songs for free without doing anything. They get the entertainment, they should pay for it. Maybe things aren't like that in the Communist paradise you people envision but this is America and you don't get something for nothing here. Of course you people are mad because of this because they caught you on your attempts at stealing and they are going to prevent it now when they win this case. Then to protect the reason that you're really mad (they caught you stealing and are going to stop your from continuing to do it) you say that Metallica sold out and the same old traditional bs claims everyone always makes against Metallica to try and scare them away from continuing with the accusations. You know this Metallica sold out stuff is really a complete joke because they've been hearing that since they released Ride the Lightning(their second album) and became the top band on the underground scene. Just because they got "big"(not really though) and starting making money they sold out? No thats bull because Ride the Lightning was as hard as Kill Em All was, and definitely a much better album anyways. Anyways I'm done, and Metallica is and always will be the greatest band of all-time.

Well, I don't consider myself as fan, but still I think Metallica is a great band. But does that make me untiteled to speak out what ever I want to say? NO! I mean Metallica can do whatever they want to do, but if they're such a good band, they shouldn't be to affected by Napster. N'sync had their record on Napster two weeks before it was released. They didn't care and still they sold a great number of copies. Metallica is doing this because of the money. But if they're doing this, and a lot of people don't buy their next CD because of this, then the've lost money. Then what's the point?

I guess I was never a fan, then. All I know is that all the time before the Napster incident, everyone was all Metallica sucks, they're sell outs and shyt like that and I was standing up and saying tell me when they sold out and defending them, and then they turn around and kick me outta Napster, for having a bootleg of thiers with Ted Nugent on my computer, and after all the time of sticking up for them, it felt like a slap in the face. I know they are defending they're rights and stuff, and I am sure all the other musicians admire them for what they are doing, but I just can't help being embarrassed. SORRY
