Daisley issued a statement to Australian rock site Undercover addressing the setback his case suffered last week and warns that ��it�s not over yet.�
"Obviously, this is a disappointing ruling, but it's not over yet,� Said Daisley in a statement. �This case has merit--Lee and I have been struggling for two decades just to receive the correct royalties and credit that's due us--and we are confident that we will prevail in the end."
Daisley and Kerslake filed suit against Osbourne in 1998 and the a court date was finally set for next February, however last week the suit was dismissed last week by a California Superior Court Judge, who said that the statute of limitations had passed. (see story)
