Teacher Scalps Free Tickets
AP Reports: A high school teacher allegedly sold his students tickets to last week's Dave Matthews Band concert in Central Park, even though the performance was a free event.

Officials said Jason Nissen, who teaches math at Frank Sinatra (news) School of the Arts in Queens, gave the tickets to his students for $30 each to the Sept. 24 concert that was attended by more than 85,000 fans. The second-year teacher denied that he sold the tickets for a profit, insisting that a friend who works for concert sponsor America Online sold him 19 extra tickets.

Nissen recieved [sic]a letter of reprimand from Eliot Salow, principal of Frank Sinatra HS, who called the math teacher's actions "inappropriate."

Officials said that he was charged last year with scapling [sic]tickets outside the U.S. Open . He pleaded guilty last month to disorderly conduct and fined $100.

Education Department officials said they would investigate Nissen -- Click Here for the Full Story

Nikki Sixx Sues Vans and Thrasher Magazine
Blabbermouth reports: MÖTLEY CRÜE bassist Nikki Sixx has sued a skateboarding magazine and the Vans shoe company for allegedly using his image in an ad without his permission, according to the Associated Press.

Sixx, whose real name is Franklin C. Feranna, said in the lawsuit filed Tuesday (September 30) that the defendants used photographs of him with pro skater Tony Trujillo at a San Francisco ceremony organized by Thrasher magazine and sponsored by Vans.

Sixx said he agreed to present Trujillo with a "Skater of the Year" award at the ceremony on Dec. 7, 2002, because he knew Trujillo was a MÖTLEY CRÜE fan.

The musician said he was surprised to see photos taken at the ceremony in an ad for Trujillo's signature Vans shoes. The photo also showed a marquee with the words "Thrasher Magazine's Skater of the Year Tony Trujillo."

The lawsuit said the caption above one of the photos, "Live Fast, Die Young," was "somewhat reminiscent of the title of MÖTLEY CRÜE's first album, 'Too Fast For Love'."

It said Sixx had also been informed that Vans and Thrasher products bearing his image were displayed at skate parks.

The lawsuit noted that Sixx has his own clothing line, "N. Sixx by Dragonfly", that seeks out the same youthful consumers targeted by Vans.

Vans attorney Craig Gosselin said the company had not seen the lawsuit, but planned to fight it.

Interesting, but didn't Nikki claim in "The Dirt" that he legally changed his name to Nikki Sixx years ago? When asked about how he responded to seeing his face in a magazine again after all these years, he answered, "Dude, I Died Dude!"

Raven Rates Metallica
Another band has jumped on the Metallica Bashing Wagon.

Blabbermouth reports: RAVEN bassist/vocalist John Gallagher, whose band headlined over METALLICA during the two groups' 1983 "Kill 'Em All For One" tour, has slammed Lars Ulrich's drum sound on "St. Anger", calling it "THE most annoying overpowering snare drum ring I've ever heard."

"I did pick up the new METALLICA [album] after hearing all the hype," Gallagher wrote in an online post. "I dunno It's like a punky, down-tuned version of 'And Justice For All' with no guitar solos & THE most annoying overpowering snare drum ring I've ever heard... That being said, there are some decent songs in here... I preferred to watch the DVD where the sound is actually better than on the CD And you get to watch Lars slowly die while playing those 360 bpm 'blast beats' ...ridiculous!!!

"Hard to say how much of this (tuned down, 8 min songs, no solos etc) is for real & how much is as calculated as 'Load' was to hit the grunge crowd....

"And then the next day I bought BLACK SABBATH 'Sabotage' & all was well with the world!!!!!

PM5K Speaks Out
siN's metal news reports: POWERMAN 5000 frontman Spider One gave the following update bout the bands status:

Alright everybody, I know your all anxious to know what's going on with this tour news, so I'm here to fill you in. Basically, the music business is in the toilet - no one is buying cds, and less and less people are going to see bands live. Every major label in America has lost an obscene amount of money this year and it's getting worse every day. Don't get me wrong, I'm not asking you to feel sorry for the labels, but the reality is this: if they're not making any money, you better believe your favorite band isn't doing too well either. So this brings me to the topic of PM5K on tour with Mudvayne. To be honest with you, this was the best tour we have been a part of all year!! Every show was incredible and the guys in Mudvayne are all very cool!! But unfortunately we are being forced to cut it short for business reasons beyond our control. This is not a situation we are very happy about at all. Sorry to all who will miss out, I wish it didn't have to be this way. But don't overreact either, since we are only talking about missing out on two weeks of shows. And I want to make it clear that the band has not broken up or been dropped from Dreamworks!! We have played about 150 shows since we hit the road back in April and it's just time for a break. Hopefully we will start touring again in the new year, so hang in there!! Again, we can't apologize enough to all of you for this situation, but everything will work out one way or another.

In the meantime, get ready for a little surprize coming up real soon. What surprize? you ask. Let's just say this - don't waste any more money on Ebay....

In related news that "surprise" is rumored to be the release of the bands never released album "Anyone For Doomsday".

Iranian Metal
Christian Science Monitor reports:: As if performing before an arena packed with tens of thousands of rock fans, guitarist Nurick Misikian lets his lightning-fast fingers energize the chords of his green-blue Fender guitar, building the sound of one of Iran's "underground" heavy-metal bands into a full-throated roar.

Driven by the pounding rhythm of Babak Riahipour's bass guitar, Mr. Misikian plays some chords overhand, and even with his teeth - turning this 12-foot square rooftop studio into a sweating paragon of ear-splitting rock music that would make Jimi Hendrix proud.

In East and West, the language of rock 'n' roll is one of rebellion and pushing the limits. And in the Islamic Republic of Iran, these musicians are creating a parallel reality that could not be further removed from Friday prayers and routine calls for revolutionary sacrifice and waging war against the West.

Many Iranian youths today are disillusioned with politics and the stalled reform movement of President Mohammad Khatami, despite two land- slide election victories that promised more social freedoms and the rule of law. And while young people increasingly turn to drugs (hits of heroin are cheaper than a box of cigarettes) and mysticism for escape, mainstream Iranian pop bands - and fringe rock groups like this one - are finding some restrictions easing.

The new band - which may be called "Shanti," the Sanskrit word for "peace" - hopes to play publicly for the first time Thursday night at a conference hall at a local hospital. That's progress: Another popular band that Riahipour helped launch four years ago, the first of its kind, never got a stamp of approval.

Could it be they are adding the new "unearthed" song?  Or maybe Sharon wanted to replace the bass, drum and keyboard tracks.

CD Sales Down
Reuters reports: The battle-weary music industry surveyed the wreckage of another dismal six months on Wednesday as global data showed music sales tumbled almost 11 percent, piling more pressure on music companies to do deals to survive.

Despite big hits from pop queen Christina Aguilera and rapper 50 Cent, [the industry claims that] Internet downloading and CD-burning continued to ravage the industry, dragging music sales down to $12.7 billion in the first half of this year, a leading industry body said.

The International Federation of the Phonographic Industry (IFPI) indicated the rest of the year may not be so gloomy however, with a strong release schedule expected to stem the slide in CD sales to between seven and eight percent.

The other half of the story is there hasn't been too many "must have" CD releases this year. The industry might want to look at that. Put it out and they will buy it; just look at all the multimillion selling CD's over the past few years that occurred in the age of the download. ...and weren't recordable cassette tapes going to kill the music business?

P.O.D. Hype Playstation
Billboard reports: The first 1 million copies of P.O.D.'s next studio album will come packaged with a second disc housing a Playstation 2 videogame, with which fans can remix a newly recorded, non-album P.O.D. track. The set, "Payable on Death," is due Nov. 4 from Atlantic.

The bonus disc will contain a version of the Playstation 2 game Amplitude, which allows users to recreate the song using its individual tracks. Using the controller, players can freestyle and scratch on top of the music, and mix the song in a number of different ways. The new P.O.D. track "Space" will be included in the video game, but not on the audio disc of "Payable on Death."

The full version of Amplitude, available at videogame retailers, features songs by the likes of Blink-182, David Bowie, Garbage, Weezer, Quarashi and Logan 7.
