Emerson Hart Week: Flyin
antiMusic reports: Rejoice Tonic fans! You Wanted More and former Tonic frontman Emerson Hart is here to give it to you. We're celebrating the release of Emerson's new solo CD, 'Cigarettes and Gasoline,' this week and have asked him to pick his favorite five songs from the CD and tell us a little bit about each one. We continue today with Flyin'. Here is Emerson: 

I love this song because it is open to many lyrical interpretations. It has specific meaning to me, but people's response on what it means to them has been very diverse. I love when a song can appeal to people for different reasons and on many levels.

Singer Witnesses Murder
antiMusic reports: Enuff Z'nuff frontman Donnie Vie recently testified at a preliminary hearing against his landlord who is accused of murdering his girlfriend. Vie said that on the day of the murder that the accused had waved a loaded gun at him and victim and that he saw her body after the murder. 

David Mahler, 43, is accused of murdering Kirstin "Chrissie" Franya Baldwin, 38, and dumping her body in a ditch near Barstow where it was found 20 days later. He is also charged with assault with a deadly weapon for allegedly threatening Vie, real name Donald Van Develde. 

Vie testified that he was at his landlords apartment before the murder when an angry Mahler pulled out a gun. "He was pointing it around, clicking it everywhere," Vie said. "He clicked it at me, he clicked it at her." Los Angeles NBC station reports that " As he was leaving, [Vie] shut the bedroom door and heard what he thought was the sound of a gun shot."- more on this story

Fan Beaten At Concert
antiMusic reports: A Ted Nugent fan was beaten during the gonzo rocker's performance Friday night at the Chicago Ridge's Ridgefest. Jim Volpe was taking photos and video with his camcorder when another man challenged him about the taping. It quickly devolved into assault when Volpe refused to turn over his camera. 

"This guy, out of nowhere, just walked up and said, 'Give me the camera,' " Volpe told Chicago Daily Southtown. Volpe told the man that he would give him the tape but not his $600 camera and the man responded, "It's too late for that now" and put Volpe in a headlock while Volpe's girlfriend grabbed the camcorder. She ran away when the man dropped Volpe and looked at her. 

Volpe spent five hours in the emergency room of Christ Medical Center in Oak Lawn for treatment of neck and back injuries.- more on this story

Fan War At Ozzfest
Blabbermouth reports: A MyFOXColorado blogger who goes by the name "Scribe2" has issued the following report: The Ozzfest at Coors Amphitheatre [in Denver, Colorado] on July 28 erupted into an absolutely ridiculous and shameful war of thrown items between the lawn-seat visitors and the reserved-seat visitors during the STATIC-X set. 

Plastic bottles, plastic cups, plastic "yard" glasses and chunks of turf were hurled from primarily mid-lawn as far as a third of the width of the second orchestra section. A few shoes and other items were also observed in flight. The fracas took on an especially sinister note when half-full bottles and empty bottles and cups were jammed full with sod, creating dangerous missiles. 

It started with a few bottles and cups being tossed into the seats from the lawn. They were mostly ignored or met by glares. However, crowd-think set in and the casual provocations became a hail of detritus from above. The people in the seats responded as comes naturally: in kind. So began an unstated war of the classes. Idol Drug Bust
antiMusic reports: He was booted off American Idol, claimed to have a steamy affair with Paula "Me Too" Abdul and now Corey Clark can add a drug bust to his resume. The fallen idol was arrested early Tuesday morning in North Little Rock, Ark., on drug charges and a warrant from Arizona. 

Pulaski County Sheriff's spokesman John Rehrauer told Billboard that Clark was arrested for possession of a controlled substance and possession of drug paraphernalia at about 2:30 a.m. The Warrant was for a failure to appear in a Arizona court for a violation of a court order and trespassing. - more on this story

Great White Manager Up For Parole
antiMusic reports: The former manager of Great White, who lit the pyrotechnics that sparked the club fire which took 100 lives in 2003, is eligible for parole in September. If approved he will be able to leave prison after serving only one third of his sentence. A hearing with the parole board is scheduled for September 19th.

Daniel Biechele, the former manager of Great White was sentenced to four years in prison after pleading guilty to 100 counts of involuntary manslaughter. Biechele was the manager of the band at the time and lit the pyrotechnics during Great White's performance at The Station nightclub in West Warwick on February 20th, 2003. The soundproofing foam at the club ignited and spread quickly through the club. 100 people died in the fire including Great White guitarist Ty Longley.- more on this story

Eminem Sues Apple Again
AP reports: The publisher of rapper Eminem's music has filed a federal lawsuit against computer giant Apple Inc. for selling downloads of his songs without permission. 

Apple has an agreement with Universal Music Group, the record company that owns the recordings, but doesn't deal directly with publishers, who own the rights to scores and lyrics.

In the suit filed Monday in U.S. District Court in Detroit, Eminem's music publisher Eight Mile Style and copyright manager Martin Affiliated seek more than $75,000 for copyright infringement, unfair competition and a violation of the Michigan consumer protection act. Muslims Hate Stefani Too
E! reports: Gwen Stefani apparently isn't everyone's favorite girl in Malaysia. A Muslim students group that objects to the pop star's sexy style and come-hither lyrics is pushing to have Stefani's first-ever concert in Kuala Lumpur scrapped before the spotlights have a chance to shine.

"Her video clips promoting the event are too obscene," Mohamad Hilmi Ramli, president of the National Union of Malaysian Muslim Students, told Reuters. "We want the organizers to cancel the concert, failing which we will ask the authorities to intervene." 

Just over half of Malaysia's 26 million-strong population considers itself Muslim, with Buddhists, Christians and Hindus composing sizeable minorities.- more on this story

Green Korn USO
PR reports: Korn announced today that they will be joining the effort to tour green by fueling all their vehicles with bio-diesel. This effort will lessen their environmental impact on this year's Family Values Tour by using domestically produced bio-fuels in all 16 of their touring vehicles. The band is working with Music Matters' SMART (Sustainable Minded Artists Recording Touring) program and Conserv Fuel to fuel their vehicles with domestically produced bio-fuel which can be derived from a variety of plant based matter including; soy, corn, and various other vegetable and animal oils. Korn is using bio-diesel for their biofuel needs which will reduce the CO2 emissions that tour produces by almost 50 tons. "We can't save the planet overnight but this is our way of saying everyone has to start somewhere. As a touring band it's our responsibility to start making a difference. We encourage all other bands touring this summer to do the same", said Jonathan Davis.

In another Korn first, [troops] on leave will be invited as Korn's guests to the Family Values Tour all over the country. In a partnership with the USO World Headquarters, tickets will be given free of charge to [troops] on leave in each local stop of this year's Family Values Tour. Distribution will be handled by the USO World Headquarters in conjunction with local bases.

Beastie Boys Add Dates
PR reports: Having sold virtually every ticket for their recently announced tour dates in support of the all-new all-instrumental The Mix-Up, Beastie Boys have announced additional full-scale shows and Gala Event Exclusive Instrumental Shows in a number of cities.

In other news, in an effort to lessen the tour's impact on the environment, Beastie Boys will make a $1.00 charitable donation from every ticket to an EcoFund through the non-profit organization ARIA (Artists Resources in Action) which supports Reverb, the outreach program to educate and engage musicians and their fans to promote environmental sustainability and fund local nonprofit organizations in the cities the tour visits. - more eco stuff and tour dates are here

Atreyu Announce Headlining Jaunt
PR reports: Acclaimed metallic rock act ATREYU have announced plans for a headlining tour in support of their upcoming Hollywood Records debut, Lead Sails Paper Anchor. The much-buzzed-about album arrives in stores on August 28th and the tour begins September 9th at the Big Easy in Boise, ID, with openers Haste The Day, It Dies Today plus a special guest to be announced.

The Dillinger Escape Plan Hire New Guitarist
Metal Underground reports: According to the official THE DILLINGER ESCAPE PLAN MySpace page, the band has added former HEADS WILL ROLL guitarist Jeff Tuttle to its lineup. 

THE DILLINGER ESCAPE PLAN recently entered the studio with producer Steve Evetts (SAVES THE DAY, EARTH CRISIS, SEPULTURA) to begin recording its new album, "Ire Works", for a late 2007 release via Relapse. 

The upcoming CD will feature the drumming of STOLEN BABIES' Gil Sharone following the departure of Chris Pennie (he now plays drums with COHEED AND CAMBRIA). - more on this story

The Go! Team Tour
Filter reports: MC Ninja and the rest of the good-time gang that comprise The Go! Team will kick off an American tour in mid-October. Their newest album, Proof of Youth, will be released here in the States via Sub Pop on September 11th. They will be hitting a few more festivals on the tail end of their jaunt around Europe, so if you happen to be on the old continent, by all means, pay homage to the band's exclamatory name and go!

Paul Stanley Takes a Lickin But Keeps on Tickin
antiMusic reports: KISS' Paul Stanley has issued a statement to reassure fans that he is fine after having heart issues last week which prompted him to pull out of a concert appearance. The masked rocker suffered what is known as tachycardia where the heart beats at an unusually high rate. In Stanley's case it was beating twice as fast as normal. 

The incident was triggered by a preexisting condition Stanley has had most of his life. Stanley said, "Like many, I have had a rapid heart beat condition most of my life and I never have had any type of restrictions. When I've had an episode, although momentarily disrupting and taxing, it has no residual effect. This is nothing new and my doctors have known about it."

He also wanted to reassure fans, "I wanted to let all of you know that I AM ABSOLUTELY FINE! I'm going to the gym as usual, painting as usual and will be going into the recording studio this week." - more on this story

The Overpriced Ticket Revolt: Can Thousands of Bon Jovi Fans Be Wrong?
antiMusic reports: This past weekend we published an editorial by Tony Kuzminski dealing with the outrageous ticket prices Bon Jovi is charging for a ten-night stand at a new arena in Newark, NJ. Tony, a huge fan of that band, was a bit outraged when he discovered that tickets were going for between $67 and $337 each before Ticketmaster added on their pounds of flesh for giving you the convenience of being ripped off by their monopoly. Tony wanted to share his honest frustration over Bon Jovi going Streisand. (e.g. bilking fans with high ticket prices.) And the truth of Tony's frustration was validated with the response to his article. 

Within a day of publishing, thousands of Bon Jovi fans had clicked over to read it and while we eliminated commenting on most of our articles a while ago, we were able to read comments on a few Bon Jovi message boards that linked the article and discovered that the fans were overwhelmingly in agreement with Tony. Bon Jovi had went too far with this ticket pricing scheme. Reportedly, a lot of fans on the Bon Jovi's official fanclub board even agreed and Tony's article sparked a healthy debate there. Unfortunately, we have to take a few fans word for that since we couldn't read the boards. (Yup, Bon Jovi wants you to pay for that too. Ok, that a bit snide. Sorry)

Nevertheless, from what we've seen and with the exception of the few expected apologist that came up with arguments like the prices are so high because it's a new venue etc, most fans feel a little betrayed by the high ticket prices. This just illustrates a growing frustration in the music business with rising ticket prices all around. Tony even wrote an editorial about that recently as well. At a time when music sales are down, not because of illegal downloading as the industry would like us to believe, but because fans don't feel they are getting their money's worth with most recent sub par releases, and concert attendance is down, wouldn't it be a better idea for bands to lower their tickets prices to attract fans back to their shows? Or is this a case of the Streisand syndrome, rip off your fans for as much as you can get because there are enough out there willing to pay the high price? Then again, can the thousands of Bon Jovi fans that read Tony's editorial and agreed with him be wrong? We'll have to wait and see but for now if you are one of the few that didn't read Tony's controversial editorial- you can read that right here.
