Love appeared in court last Thursday to testify before a judge to determine if her mental health was stable enough to return Love�s daughter to her custody.
Love�s 11-year-old daughter with the late Kurt Cobain, Francis Bean, was placed with Cobain�s mother by the Los Angeles County Department of Children and Family Services following Love�s arrest on October 2nd.
Shortly after her arrest, Love was rushed to the hospital for a reported drug overdose of OxyContin.
Love was remanded to the Las Encinas Hospital in Pasadena on October 10th. She was held on a 5150 charge, which allows mental health hospitals to hold an individual for up to 72 hours against their will for observation.
Love �escaped� from the facility 24 hours after she was placed there and reportedly roamed around Pasadena knocking on strangers doors.
Love contends that her daughter was fine the night of her arrest, at home asleep under the care of her live-in nanny. California authorities had different ideas. The issues were reportedly not solved during the hearing last Thursday and the child has not been returned to Love�s custody.
Love may also face another legal challenge from her late husband�s former bandmates. Last April Dave Grohl and Krist Novoselic took Love to court, asking a judge to order a psychiatric evaluation. Citing a stipulation in the partnership agreement between the band members(Grohl and Novoselic) and the widow of the late Nirvana frontman Kurt Cobain (Love), Grohl and Novoselic filed a motion on April 11th asking the court to order Courtney Love to undergo a psychiatric evaluation to see if she is mentally competent enough to exercise her side of the partnership.
When Love and the former Nirvana members formed Nirvana LCC, a business partnership between the parties that was setup to handle Nirvana related issues, a provision was included that gave any of the partners the ability to request another's mental heath be evaluated for competency.
The judge ultimately denied the motion (see story) but with the latest drama in Love�s life, there is a chance that Grohl and Novoselic will revisit the issue.
