(antiMusic) Remember that song theft lawsuit awhile back where the writer of a tribute song to the Boston Red Socks claimed that Bon Jovi borrowed from his track? The Boston Herald has this update about the case, or rather the end of the case: A Chelsea musician is back to "Livin' on a Prayer" now that his $400 billion lawsuit against Jon Bon Jovi and Richie Sambora over dueling baseball ditties has struck out with a federal judge.

Samuel Bartley Steele, 38, claimed in his copyright-infringement lawsuit that the rock 'n' roll dream team's "I Love This Town" from their 2007 studio album "Lost Highway" was a rip-off of his 2004 ode to the Red Socks, "Man I Really Love This Team."

In granting summary judgment last week to the New Jersey superstars, District Court Judge Nathaniel M. Gorton found, "Applying the 'ordinary listener' standard, this court detects no musical similarity between the Steele song and the Bon Jovi song." - more on this story
