Misuse of Samantha Fox Comeback Song?

Marc Mysterio sent out a statement about filing suit for the unauthorized use of the track he wrote and produced for Samantha Fox in 2009 which brought the star back into the spotlight. Here is what was sent out:

In 2009, House Planet, amongst others, was proud to bring to you the comeback song of Samantha Fox, 'Tomorrow', featuring Marc Mysterio. Indeed, Marc had written and produced the record which was added to her 2009 Sony Music Greatest Hits album. In France, Pool E Music signed the song, but not the publishing, and it remained on the Musibox Club Charts for over 1 year and sold in excess of 30,000 units.

We are now 2012 and Pool E priority artist and all around good Guy Tristan Garner, releases a song calle 'Shine Again' featuring one Abigail Bailey.

The song contains the same verse and pre chorus as Samantha's song yet sub substitues 'Tomorrow is another day' for 'take me to the promise land'.

Since that time in 2009, Marc has become an exclusive artist on Sony Music and a stanch advocate for Beatport as a way to break artists on Sony from smaller Eastern European Affiliates with big name remixes as a way to start commercial songs off using "Tomorrow" as a reference point of success.
