The appeals court found that Napster "raised substantial questions (on) both the merits and the form of the injunction."
Napster must still
fight Wednesday's decision by U.S. District Judge, Marilyn Hall Patel.
The San Mateo Company now has until August 18th to file a legal brief with
the U.S. Circuit Court of Appeals. They will then have until September
8th to file a responding brief with the court. The Court will at that time
set a date to hear oral arguments on the issue. If the appeals court upholds
the injunction, than Napster will have to shut down their service pending
a trial.
