Russells attorney Neil Philbin told the Herald that the signer was relieved that he was not indicted but he also remains tormented by his role in The Station Fire which took the life of 100 people including Great White guitarist Ty Longley.
"Jack is still agonizing over this," Philbin said. He also said that Russell "expressed his sorrow about this entire tragedy." And the signer remains "devoted" to performing benefit shows to help raise money for the families of the victims.
The grand jury handed down indictments yesterday against the bands tour manager Dan Biechele, and club owners Jeff and Michael Derderian. All three were charged with 100 counts of involuntary manslaughter with criminal negligence, and 100 counts of involuntary manslaughter in violation of a misdemeanor.
Each count carries a maximum sentence of 30 years in prison, prosecutors said on Tuesday.
Jeffrey Pine, an attorney for one of the club owners, Jeffrey Derderian, told reporters that his client and his brother "are not criminals, they did not commit a criminal act and should not be facing criminal charges."
According to Reuters, Rhode Island Attorney General Patrick Lynch noted that the indictments do not allege -- and the crime of involuntary manslaughter does not require -- proof that the defendants intended to cause the deaths of 100 people.
Accordingly, he accused the Derderians of failing to properly maintain the nightclub by keeping the foam on the walls. He accused Biechele of lighting the pyrotechnics that started the fire.
The sound man for the night club, Paul Vanner, also spoke with the Herald and he believes that Russell should share the blame.
"Jack definitely had something to do with it," Vanner said. "Dan Biechele can't just go out and OK an expense like pyrotechnics. If GREAT WHITE's footing the bill, Jack Russell is going to know about it.
"What the band did in the past should definitely have a bearing on this."
