But the band have argued through their attorney that his case should be dismissed for a string of technical reasons. They say Duce listed his replacement, Jared MacEachern, and their new record label, Nuclear Blast, in his papers - but he's levelled unconvincing charges against them.
They say he's also claimed breach of trademark, despite admitting he has no rights to the band name or logo. The band motion, filed by lawyer Dawn Coulson, says: "Plaintiff, a former partner to the Machine Head partnership, now sues the Band and the other Defendants for federal trademark infringement, alleging that the Band and the other Defendants have used 'a mark identical to MH's federally registered mark without Plaintiff's required consent, for and in connection with Defendants' musical recordings, live shows put on by the Band, and with merchandise including but not limited to clothing and headwear.'"

"The song's lyric bubbled up a few days later as I was awaiting her arrival at my apartment as a wonderful gloomy storm brewed over the Hollywood Hills.
"At the heart of most of these songs there is a woman and I consider myself privileged and blessed to have known these various manifestations of the great eternal muse. Some for only moments and others for many years. This is an album that has been percolating for a long time and during it's execution, I believe that I have finally managed to access my inner Serge Gainsbourg! "

New England quintet Aerosmith hatched in January 1973 with their self-titled album, but it wouldn't be until the release of their sophomore effort Get Your Wings in Spring 1974 that Aerosmith would take off by defining the sound that would soon become America's premiere hard rock band.
For Get Your Wings, Aerosmith enlisted the talents of producer Jack Douglas, whose crystal clear production provided a much needed boost sonically, as proof on the Aerosmith classics "Same Old Song and Dance", "Lord of the Thighs", "S.O.S. (Too Bad)", "Seasons of Wither", "Pandora's Box" and the all important matrix that gave New Yorker Steven Tyler common ground with New Hampshire boys Joe Perry and Tom Hamilton, The Yardbirds' "Train Kept A Rollin' ".
It is the solid bottom end provided by drummer Joey Kramer and bassist Tom Hamilton with Joe Perry's stiletto guitar licks a top the weaving three dimensional rhythm guitar play of Brad Whitford that makes Aerosmith's instrumentation so alluring. Steven Tyler's distinctive voice seduces the ears of listeners, and together the band would explode a mere album later with Toys In The Attic.
Joey Kramer tells InTheStudio host Redbeard how the hard work put into the band in those early years has been the reason Aerosmith's sound remains timeless today.
"An album like this (Get Your Wings) is what it is because of how it was made, and the amount of time that was spent on those songs and recording this record is the reason why it will stand up ten years from now."

Most people know Lennon from her debut album, 5:30 Saturday Morning, which was released by Arista Records back in 2001. She now returns with It's War and their debut single and video entitled "Heart".

Napalm Death's Shane Embury had this to say, "Since I was blessed with being introduced to Cardiacs way back in 1986 they have been one of my favorite bands of all time! Getting to meet and become friends with Tim Smith, the musical genius behind it all, over the years was an added bonus. Tim always struck me as a person with a massive heart, who had a very pure and innocent view of the world in which we live in - something I totally related to, as the world can be a dark place - he radiated happiness.
"We shared many fun and elaborate conversations after Cardiacs shows in the early 90's and I loved every minute of every conversation with him. I could go on and on for hours about how amazing his music is and the immense influence it has had on my life but suffice to say this cover of 'To Go Off And Things' that we have recorded is in tribute to the brilliance that is Tim Smith - it is the least we can do for a man who has given us so much.
"Tim has unfortunately been severely unwell for a few years now and we hope with this recording made available to everyone for download on our bandcamp site for only 1 (you can pay more if your heart so desires!) we can help raise some money to go towards Tim's rehabilitation! We hope you like our version of the song and find it in your heart to donate something towards such a worthy cause...Thanks for taking the time to read this."

Hectic schedules meant every man in the veteran prog outfit was recording material at the same moment as they rushed to complete sessions before continuing their current world tour.
Davison, who makes his studio debut with Yes on the July release, tells ProgReport: "We finished recording just in time - we had to leave. We were doubling up in the studio. Chris Squire and I were working on background vocals and Steve Howe was finishing guitars. Geoff Downes was in Wales, Alan White was in Seattle and they were both sending tracks.
"We were just kind of throwing everything in at the last minute, then we only had two or three days before we had to start this tour."

"distant satellites is the culmination of everything Anathema been working up to so far in our musical path. It contains almost every conceivable element of the heartbeat of Anathema music that it is possible to have.
"There is beauty, intensity, drama, quietude, and extra musical dimensions that the band has previously only hinted at. All built on the song writing chemistry of Daniel, John and Vincent ~ and the haunting voice of Lee Douglas.
"Produced and mixed once again by our very own Christer-Andr Cederberg (Weather Systems, Universal) and with some songs also mixed by the unassailable Steven Wilson, It's a special and unique release for the band.
"Anathema hopes the fans get as much joy from listening to and feeling the music as we did in creating it."

He'll mark 30 years with Bruce Springsteen's outfit in June this year - but he remembers how his first-ever appearance made him feel like he was a "deer in the headlights."
Lofgren tells Rolling Stone: "I was on the front line with Bruce, and I learned early on he likes to improv a lot; call you over and have you sing over there instead. The main thing I learned is you have to watch him.
"It took me about 20 shows to get to the level of comfort, not for lack of help from Bruce and the band. My main chore was integrating 60 or 80 songs into my psyche."

"The Burden of Being Wonderful" was one of the last songs written for "All You Can Eat". The entire record was pretty much in the can. Then, one day, there was a conversation amongst our management/ record company peeps about how hard core our new record was lyrically. They all had their panties in a bunch, sitting there whining about how hard it would be to get us on the radio and into more traditional outlets with such "aggressive" lyrics. But I decided to write something that day that was anthemic, catchier than the Ebola virus, and with subject matter that was not only fine for toddlers, but undeniably Steel Panther as well.
Def Leppard is a hit machine. So "Hysteria" became my template. I started to muse about what it must be like to be Jared Leto. To have an ego that big. To feel as if you had been touched by the hand of God. I thought about how I wanted to stab him in the neck. Then I thought about all the super hot, insecure young women that he gets to take advantage of on a nightly basis. When I was done masturb**ing, the lyrics were complete.
I demoed the song in my closet and after playing with some production ideas, (adding the melody on the strings, putting some delay on the vocals in strategic spots), I emailed it to the rest of the band through the magic of Al Gore's internet. It was decided by all we should go into the studio the next week and record it for the new record. I'm glad we did. Now the world can begin to understand the burden that Jared Leto lives with every day.
