The Phillips family-owned Albany Sporting Goods and Pawn -- which has been in the family for 24 years -- is scheduled to hit the auction block on December 1st ... and we're told, Phillip's dad hopes to use the profits to cover the family's mounting debt. We're told Phillip's dad hopes to bring in between $200,000-250,000 during the auction. We're told Phillip's family has reached out multiple times to the singer for financial help since he hit it big, but Phil has blown them off. According to Phillips family sources, the family's especially hurt by the singer's radio silence -- since they spent a ton of money on travel expenses so they could see Phillip compete on "Idol." We just spoke to Jamie on the phone, and he tells us, he's pleased the judge tossed out Sam's defamation lawsuit against the Spears family -- before it went to jury -- but he expressed disappointment at not being able to take the stand and tell the "real" story. Jamie says it was painful to relive the darkest days of Britney's life -- when he thought Britney might actually die -- but no one took it harder than Brit's mom Lynne. Jamie says Britney hasn't spoken to Lutfi in four or five years. As we reported, an L.A. judge dismissed Lutfi's lawsuit against the Spears family yesterday for lack of evidence -- a lawsuit in which Lutfi claimed the Spears family defamed him, physically attacked him, and breached a management contract he had with Britney. As for Britney's conservatorship -- Jamie says he DOES foresee an end, but he's not sure when exactly. And when it comes to "X Factor" -- Jamie says his daughter got off to a rough start because of nerves ... but she's gotten better and better every week. more on this story

TMZ broke the story ... a songwriter named Guy Hobbs sued Elton back in April, claiming Elton jacked his lyrics ... then used them to pen the chart-topping 1985 hit "Nikita." Hobbs wrote a song called "Natasha" about a Western man falling for a Russian woman during the Cold War. Elton shot back by asking the court to dismiss Hobbs' lawsuit -- claiming a Grammy-winning musician such as himself would never steal lyrics from some no-name songwriter. Elton also argued the theme of "Natasha" is too general to win copyright protection. The judge agreed, so case closed.
"We moved the show up because of the hurricane, so my stuff that was being sent was stuck on the East Coast," Khloe tells Hollyscoop last week at the "X-Factor" taping, "That top [arrived from the East Coast] first thing." Some media outlets are calling the wardrobe malfunction a "booby trap" saying it was all staged for ratings, but Khloe swears she wouldn't walk on stage with hard nips on purpose. "The shirt was lined and everything! I'm surprised that much showed!" says Khloe, "When I went on, Simon was like motioning to me to cover up, and I was like, 'what's he doing?'" more on this story
Law enforcement sources tell TMZ ... police received a 911 call around 6:00 PM on Friday to a home in Beverly Hills. We're told when cops arrived, they were told a fight between Nouri and his girlfriend had turned from her verbal to physical. According to our sources, cops observed Nourit's girlfriend with visible marks and arrested Nouri on the spot. He was held on $50,000 bond and released around 1:00 AM Friday morning. more on this story
Christina opened the broadcast of "Hurricane Sandy: Coming Together" with a rendition of her hit, "Beautiful." Money collected will be donated to the American Red Cross relief efforts for Hurricane Sandy. Watch her performance here.
The song is the second track issued from the band's forthcoming sophomore effort, "Take Me Home," following the lead track, "Live While We're Young." "Little Things" is one of two songs written by UK singer/songwriter Ed Sheeran for One Direction's upcoming release. Watch it here.
As TMZ first reported, a man named Robert Poindexter sued 50 ... claiming the rapper hijacked a sample of his Persuaders song "Love Gonna Pack Up and Walk Out." Robert claims 50 used it on his track "Redrum," which he released for free online. But in recently filed court docs, 50 says the suit is bogus and claims he never violated any copyright laws. In fact, he says Robert doesn't even own the rights to the allegedly-stolen song because he signed them over to Warner Music Group awhile ago ... therefore he can't sue. 50 is asking a judge to dismiss the case ASAP. Every ticket to the April 13 concert at University of Georgia's Sanford Stadium and the second show of a two night stand at Boston's Fenway Park on July 12 was swept up in under an hour Friday morning. The first night at Fenway sold out in a record seven minutes. "I got to open the CMA Awards last night with two of my really good friends, and then I got to wake up this morning with more sold out stadiums�are you kidding me right now?" said Aldean on Friday. "The list of guys in country music who sell out stadiums is pretty short, it's guys like Chesney and Garth�I'm not supposed to be on that list. It's a big testament to the hard work my band and crew put in every night out there and to the loyalty and passion of country music fans. It doesn't get any better than this." more on this story
Law enforcement sources tell TMZ ... Wright -- who starred in the classic movie "The Five Heartbeats" -- was trying to park his 1978 black Rolls Royce in Manhattan when he hit the car that had two officers sitting inside. We're told the officers went to have a word with Wright and detected an odor of alcohol on his breath. After the field sobriety test didn't go Wright's way, the officers arrested him. Law enforcement sources tell TMZ right's blood alcohol level was well above the legal limit. We're told both officers were taken to a local hospital to be checked out after the accident. more on this story

We're told Ed's alcohol addiction goes back decades -- and he was inspired by his daughter to finally clean up his act. It seems the folks who run the joint want to keep father/daughter apart, because they haven't seen each other yet ... they're at opposite ends of the facility ... but we're told they'll definitely come together for some family therapy sessions. TMZ broke the story ... Nadya's in a 30-day program for Xanax dependency, while her kids are at home on their best behavior ever ... in the good care of 3 nannies. more on this story
Sources close to Kendall tell TMZ ... several members of Kendall's team became concerned after some overzealous fans began camping outside of the 22-year-old's L.A. pad ... and they urged him to get another place where he could hide out. We're told Kendall took the note and quickly found a place in Las Vegas -- inside a well-protected gated community. more on this story
As TMZ previously reported, Goldblum scored a three-year restraining order against Linda Ransom back in June. Goldblum had claimed that Ransom constantly followed him in public, showed up at his house uninvited, and appeared on multiple occasions at his stage performances in NYC and L.A. The Los Angeles County Sheriff's Department arrested Ransom last night when she showed up at the Ahmanson Theater in Los Angeles where Goldblum is currently starring in a play. We're told Ransom got within 20 feet of Goldblum; the restraining order calls for her to stay 100 feet away from him. Ransom was booked just after 2:00 AM this morning and is currently still in custody. Her bail is $5,000. more on this story
Marc was out walking his dog Friday in New York -- and he told us, he had to move uptown temporarily because Sandy completely destroyed his West Village apartment. Marc says it's so bad, he hasn't even been able to go back to try to salvage some of his belongings. more on this story
In Jimmy's office before the show, Christina, Jimmy, and The Roots grabbed some office supplies and used them as instruments to perform Christina's new single, "Your Body." The track is the first song from Aguilera's "Lotus" album, due November 13. Watch the performance here.
